The Lagos State High Court sitting in Ikeja has declared the removal of Mudashiru Obasa as Speaker of the Lagos State House of Assembly illegal and unconstitutional.
EpeInsights learnt that Justice Yetunde Pinheiro, while delivering judgment on Wednesday, voided the proceedings and resolutions of the House in January, which led to Obasa’s removal.
Obasa had approached the court to challenge his ouster, naming the Lagos State House of Assembly and Mojisola Meranda—who was announced as his replacement—as defendants.
Through his counsel, Chief Afolabi Fashanu (SAN), Obasa argued that 36 lawmakers orchestrated his removal while the Assembly was on recess and he was out of the country. He contended that the session was not only unauthorized but also violated the Assembly’s internal procedures.

The former Speaker maintained that no formal delegation of authority was given for the session that removed him, rendering it null and void.
His suit, anchored on nine legal grounds, referenced relevant sections of the 1999 Constitution (as amended) and the House’s Standing Orders.
Justice Pinheiro upheld Obasa’s arguments, ruling that due process was not followed and that the removal did not comply with constitutional or legislative requirements.
